Do I Have a Case for California Premise Liability?

If you were injured on the property of another, you may be considering filing a lawsuit seeking compensation for your injuries. In California, it is your right to recover damages from a negligent property owner, provided you could satisfy the requirements of California law. If you are invited onto the property (invitee), a property owner has a duty of care to you. However a court may consider if you contributed to your own injury by being under the influence of drugs or alcohol, for instance. If you were intoxicated and fell, a court may rule that your condition was the main contributing factor to your injuries, [...]

Preventing California Workplace Injuries

April 28, 2018 marks the 47th annual Workers Memorial Day, an international day of remembrance for workers who were injured or lost their lives on the job. It is also the day OSHA was established in 1971. Under the Occupational Safety and Health Act of 1970, employers are responsible for maintaining safe and healthful workplaces. It is the role of OSHA to ensure safe conditions by providing training, education and assistance as well as enforcing standards. In California, agricultural and construction far outpace all other industries in the rate of injuries and fatalities. In a report released on Workers Memorial Day by Worksafe last year, there [...]

Study Shows Severe Burn Injury Patients Have a Greater Survival Rate

Surviving a severe burn injury is a lot more likely today, thanks to major advances in treatments made over the past thirty years, according to a study published in the Journal of American College of Surgeons. Since improvements in burn care transpired in the 1980s, the study was the first to have analyzed the progress made on the affects to burn injury patients. “Mortality has decreased three to fivefold since the 1980s ostensibly from the substantial advances in burn care that occurred between 1980 and 1989,” according to a statement in Medical News by the lead study author David N. Herndon, chief of staff and director [...]

OHSA: Fall Protection Training Added to Top Ten Violations List

While Fall Protection General Requirements remained at the top of the Occupational Health and Safety (OSHA) list of top ten violations, a new addition moved into the number nine spot on the list – Fall Protection Training Requirements. This entry preceded a new study released in January from data from the NIOSH Fatality Assessment and Control Evaluation (FACE) program, which showed that almost half of all construction related fatalities involved falls. Of those workers killed, 54 percent had no access to a personal fall arrest system (PFAS) or had one and failed to use it. The new entry to the OSHA top ten list, entitled Fall [...]

Workers Compensation and Third Party Liability

When the topic of workers compensation is brought up, most people think of the construction industry, factory work, or some other inherently dangerous occupation. In reality, a serious job related injury could occur to persons working in the most acquiescent of environments. Any employee who is injured on the job should be covered by workers compensation, provided by his or her employer. As the name implies, workers compensation provides the replacement of lost wages for injured workers who are unable to perform their jobs. In addition it provides their employers protection against a lawsuit resulting from the injury. What it does not provide is long-term financial [...]

Railroad Crossings and Truck Accident Prevention

Railroad accidents between a truck and a train were once more thrust into the forefront of the media after a train carrying members of the Republican congress struck a semi- truck at a railroad crossing. The crash resulted in the death of one truck occupant, injury to another and minor injuries to several passengers and crew of the train. In the South Carolina crash it was determined that the truck went around a crossing gate that was in the lowered position. Residents in the area said that the gate often became stuck in the closed position tempting impatient drivers to go around it. Safety Measures for [...]

Despite Available Safety Technology, Another Fatal Train Derailment

As Federal investigators look for the cause of the Amtrak derailment in Washington, that left three dead and dozens hospitalized, the question still remains – with the available technology, why are train derailments still occurring with such frequency? The brand new train traveled its maiden voyage on upgraded tracks 50 miles south of Seattle and suddenly left the tracks careening off an overpass onto I-5. Investigators confirmed that the train was traveling 80 mph while attempting to handle a curve with a 30-mph speed limit. The black box recovered from the rear push engine indicated that there was no attempt at manual braking by the operator, [...]

Many people have turned to electronic cigarettes as a safer alternative to smoking or as a way to quit, but just how safe are e-cigarettes?
