Third Party Liability in Construction Accident Injuries

The most common workplace accidents in the nation are construction accidents. The Bureau of Labor Statistics for the US Department of Labor conducted a study which showed that there are between five and six thousand deaths caused by construction accidents annually. Most construction companies provide safety training to workers; however serious accidents are still happening with great frequency. Construction is, without question, the most dangerous industry due to the many potential hazards that are always present. Construction companies in California, as well as the many trades, are required carry worker’s compensation insurance. How Essure Birth Control Injured Thousands of Women

The Essure System was first submitted to the FDA in April of 2002 as a form of permanent birth control by Conceptus, which was subsequently bought by Bayer. The FDA gave the system approval in November of that same year. The Essure system consists of nickel-titanium and stainless steel coils, which are wrapped in polyethylene terephthalate and inserted into the fallopian tubes. The devices cause irritation to the area, developing fibrous scar tissue which creates a blockage, preventing the descent of eggs. The FDA imposed several requirements on the maker, including an adequate, physician training program and a warning label concerning information about failure and success [...]

What to Do After a Hit and Run Accident

California law requires drivers to stop after being involved in an auto accident. Unfortunately, not all drivers obey the law. It’s routine to see drivers speed or engage in distracted behaviors, such as texting, eating, and more. Because there’s a plethora of distractions competing for our attention at all times, we take our focus off the road. Even when paying attention to the cars around us, it’s still possible to be surprised. For these and a variety of other reasons, hit and run accidents occur. So, it’s very important to know what to do after a hit and run (as well as what not to do.) [...]

Essure Lawsuits Can Move Forward without Preemption California Judge Rules

Lawsuits totaling more than 900 have been filed in California against Bayer Healthcare for serious side effects caused by their contraceptive device Essure. Until early this month Bayer has successfully kept the door locked against more than 40,000 complaints related to Essure but a ruling by a judge in California may have smashed down that door. Judge Winifred Smith of the Superior Court in Alameda County granted a motion in the beginning of October to coordinate 55 cases filed against Bayer. At the same time, she sided with the plaintiffs against Bayer concerning pre-emption. Bayer contended that plaintiffs were not allowed to file suit under federal [...]

Distracted Driving Accidents on Rise Due to Pokémon Go Players

Back in July of this year, a police body cam video went viral, showing three Baltimore MD police officers standing and having a conversation when an SUV suddenly slams into their parked patrol car. Moments later, the driver emerges from the SUV, which came to a halt hundreds of feet down the street, with phone in hand saying “That’s what I get for playing this dumb game.” It was not the game that was dumb. Fortunately, no one was injured. Many people thought this video was funny, leading to it going viral. However, there is nothing funny about distracted driving. In fact, of the 421,000 people [...]

Jury Awards $70 Million in Johnson & Johnson Talc Cancer Lawsuit

After a trial that began on Sept. 26 and ended on Oct. 27, a jury in St. Louis ordered Johnson & Johnson to pay $70 million to a California woman, who claims that the company’s talc based products, which she used for feminine hygiene, caused her to develop ovarian cancer. The verdict was the third large award in a row that Johnson & Johnson was ordered to pay this year. In May, the same court awarded $55 million in damages to a South Dakota woman who underwent a hysterectomy due to ovarian cancer, allegedly caused by lifelong use of the product. In February, the family of [...]

Overloaded Trucks on Our Highways Despite Regulations

Tractor trailers, due to their size and weight, are inherently hazardous. An overloaded or improperly loaded trailer increases the risk of a truck accident significantly. A tractor trailers cargo weight limit is determined by the Gross Vehicle Weight Rating (GVWR) calculated by brake, powertrain, frame and suspension limitations. An overloaded 18-wheeler is operating with a dangerous strain on that equipment. The stopping distance of the truck is dramatically increased. The truck is more likely to jackknife, especially on wet roads. With a raised center of gravity and the possibility of load shifting, the chance of a rollover is much higher. Some overloaded trailers have been known [...]

Auto Accidents and Concussions

Auto accidents and concussions go hand-in-hand. Sadly, too many car accident victims experience mild to severe concussions and might not know about the condition for a day or more thereafter. This is because of a common misconception that those who experience a concussion will always lose consciousness. But you don’t have to be knocked-out cold to suffer a concussion. You might not even experience a lapse in memory, but are unable to recall what happened right before the accident. What’s more, people who suffer a concussion might not have outward, visible head injuries, like cuts and bruises. Auto Accidents and Concussions What’s most important to understand [...]
